    • In Lockport, NY on February 4th, 1867 he pled guilty to larceny and burglary, third degree. He was sentenced to three years six months in prison. Then in February 1871 Byron was sentenced for robbery to seven years of hard labor at Auburn State Prison. He served five years. Then again on March 23rd, 1877 Byron received a 15 year sentence for larceny and burglary. Angered by the length of his sentence, Byron threw an inkwell at the judge, thereby earning himself an additional five years in Auburn State Prison. In September 1877 he escaped from the prison but was captured on November 3rd, 1877. He made his second escape from Auburn State Prison in 1885 however was recaptured in Buffalo in January 1886 after a running fire fight with a pursuing detective. He was finally released November 22, 1897. In the fall of 1898 he was convicted of burglary, third degree after an attempted house robbery in Albion, NY and sentenced to a year in the Erie County penitentiary.
      Byron Day was not a stupid man; the clever nature of his prison escapes is testimony to that. According to the "Daily Courier" he was one of the sharpest stripes in prison.
